SC dismisses PIL for acceptance of MLA

The Supreme Court on Monday dismissed a PIL seeking a direction to the Andhra Pradesh Speaker to accept the pending resignations of over 130 MLAs on the explosive issue of creation of Telangana state and lambasted the petitioner for misrepresenting himself as an MLA. Petitioner M Narayan Reddy, claiming to be ex-MP and MLA from Nizamabad, had sought a direction for acceptance of the pending resignations of the MLAs. Before dismissing his PIL, a Bench comprising Chief Justice K G Balakrishnan and Justices J M Panchal and Deepak Verma took him to task for misrepresentation as well as on the issue of his locus standi. "You are neither a sitting MP nor an MLA. What right do you have to speak on the behalf of the MLAs? Who are you to seek a direction for acceptance of the resignation of the MLAs," the Bench asked. When his counsel Subodh Markandey tried to explain that his client had filed the PIL as a political leader in his own right, the Bench said, "Who gave you the right to represent the other MLAs. We will not even hear you because you have misrepresented." The PIL had become infructuous as on January 30, AP Speaker N Kirankumar Reddy had rejected the resignations of 130 MLAs saying they were not in order as per the rules and procedure of the Assembly.
